On Monday, Diallo received a call from his frantic wife telling him that a man had broke into apartment and attempted to rape her. The deceased man identified as Earl Nash allegedly assaulted Diallo’s wife and sister-in-law before he left their south Bronx apartment. Diallo left his Lyft driving job and immediately headed to his apartment to check on his family. At some point he came Face to face with Nash and began striking the deceased with a tire iron he was carrying. From the video you can see that Diallo and Nash fighting inside the elevator but the video ends shortly afterwards. Notice in the video, the man is semi-clothed when he encounters Diallo.
Police records show that Nash had 19 prior arrests on various charges, which included arson, robbery and assault.
Diallo’s court date is set for June 27th in Bronx Superior Court.
