A Georgia schoolteacher won’t be going back to the classroom any time soon if the family of a 17-year old boy has their way. Rene Chantel Frank has been charged in Georgia with sexual assault of a person in school for having sex with her male student.

While the sex was consensual, Georgia law forbids any sexual contact with school personnel and students even if they are of age and give consent. What makes matters worse for this teacher is she claims that she is now carrying twins for the teen.

The judge in the case was not moved by her circumstances and ordered her held without bail. According to the police report, the teacher is alleging that she had sex with the teen while off campus in the back seat of her car. Frank taught math at Charles Drew High School in Riverdale, GA and if she is found guilty, she could be sent to prison for up to three years and have to register as a sex offender.

What are your thoughts on this story? Should the teacher be prosecuted for having consensual sex with the teen based on what is prescribed in Georgia law?

Here is what the law says:

    1. A person commits sexual assault when such person has supervisory or disciplinary authority over another person and such person engages in sexual contact with that other person who is: In the custody of law; or detained in or is a patient in a hospital or other institution.

    3. Consent of the victim shall not be a defense to a prosecution under this subsection.

    4. A person convicted of the offense of sexual assault under this subsection shall be punished by imprisonment for not less than one or more than three years.
